Road Hazard Protection Inquiry

I bought tires from Sam's club with the install package that includes the road hazard protection. One of the tires now has what seems to be non-repairable sidewall damage after curb contact while maneuvering. Has anyone here had the TBC approve or deny this kind of driving hazard?
